Terms and Conditions of Use

1. About ARLINOS
ARLINOS is a cloud-based business management platform designed primarily for salons, beauty professionals, barbers, hairdressers, beauty studios, wellness businesses, and related service businesses.
Depending on the selected subscription plan and available functionality, ARLINOS may provide features including:
- Appointment and booking management
- Customer relationship management
- Calendar and scheduling
- Customer records
- Inventory management
- Products and services management
- Payments
- Invoicing
- Business analytics
- Marketing functionality
- Communications
- Artificial intelligence functionality
- AI-assisted booking
- Business automation
- Integrations with third-party services
- Additional business management tools
Features may vary according to subscription plan, country, configuration, and availability.
2. Eligibility and business use
ARLINOS is primarily intended for professional and business use. You must have the legal capacity to enter into a binding agreement to create or operate an ARLINOS account.
If an account is created on behalf of a business, the person creating the account represents and warrants that they are authorized to act on behalf of that business.
3. Account registration
Certain features require an ARLINOS account. You agree to provide accurate, complete, and current information during registration and to keep this information updated.
You are responsible for:
- Maintaining the confidentiality of your credentials
- Controlling access to your account
- Managing authorized users
- Assigning appropriate permissions
- Activities performed through your account
- Promptly notifying ARLINOS of suspected unauthorized access
Accounts and credentials must not be shared with unauthorized persons. ARLINOS may implement additional authentication or security requirements when reasonably necessary to protect the Platform and its users.
4. Administrators and authorized users
Business accounts may permit multiple users. The account owner or authorized administrator is responsible for managing employees, contractors, account administrators, user permissions, roles, and access rights.
The customer is responsible for ensuring that its authorized users comply with these Terms. Actions performed by properly authenticated authorized users may be treated as actions performed on behalf of the account holder.
5. Subscription plans
ARLINOS may offer different subscription plans, including plans such as Starter, Pro, and Premium, as well as add-ons, promotional plans, trials, custom plans, or future subscription tiers.
Features, usage limits, included services, storage, integrations, AI functionality, and other entitlements may differ between plans. The features and pricing presented at the time of purchase or subscription form part of the applicable commercial agreement. ARLINOS may introduce, modify, or discontinue plans in accordance with these Terms and applicable law.
6. Free trials and promotions
ARLINOS may offer free trials, demonstrations, promotional periods, discounts, or introductory pricing. Eligibility and duration may vary. Unless otherwise stated, a trial does not guarantee continued access to all features after the trial period. Before a paid subscription begins, ARLINOS will provide applicable pricing and payment information where required. Promotional pricing may expire according to the conditions presented with the promotion.
7. Fees and payments
Paid subscriptions must be paid according to the billing cycle selected during purchase. Prices are displayed before purchase and may be subject to applicable taxes. By providing a payment method, you authorize ARLINOS and its authorized payment providers to process charges associated with your subscription and authorized purchases. Customers are responsible for maintaining valid payment information. Where recurring billing has been expressly agreed, applicable subscription fees may be charged automatically until cancellation.
8. Price changes
ARLINOS may change subscription pricing from time to time. Price changes affecting an existing paid subscription will be communicated in advance where required by applicable law or contract. Continued use following the effective date of an appropriately notified pricing change may constitute acceptance of the new pricing, subject to applicable law and any cancellation rights available to the customer.
9. Cancellation
Customers may cancel their subscription through the available account settings or another cancellation method provided by ARLINOS. Unless otherwise stated in the applicable subscription agreement, cancellation becomes effective at the end of the current paid billing period, and the customer may continue using applicable paid functionality until the end of that period. ARLINOS does not automatically provide refunds for unused portions of a billing period unless required by applicable law or expressly agreed otherwise.
10. Appointments and bookings
ARLINOS provides technology that businesses may use to manage appointments and bookings. The salon or service provider remains responsible for:
- Services offered
- Service descriptions
- Prices
- Availability
- Appointment duration
- Staff availability
- Cancellation policies
- Customer communications
- Service delivery
- Refund policies
- Applicable taxes
ARLINOS is not the provider of the salon or beauty service booked through the Platform. A booking made using ARLINOS establishes a relationship between the relevant business and its customer, not between the end customer and ARLINOS, except where expressly stated otherwise.
11. Booky — AI booking assistant
ARLINOS may provide an artificial intelligence booking assistant known as Booky. Booky may assist with functions such as:
- Responding to booking inquiries
- Checking available appointment times
- Creating appointments
- Assisting customers with booking-related questions
- Supporting booking conversations
- Voice or telephone booking where enabled
AI-generated responses may occasionally contain errors or misunderstand user requests. Businesses are responsible for configuring their services, schedules, availability, policies, prices, and other relevant information accurately. Where appropriate, users should verify important appointments, changes, cancellations, pricing, or other business-critical information. ARLINOS does not guarantee that AI-generated interactions will always be error-free.
12. Atlas — AI product assistant
ARLINOS may provide an AI-powered product assistant known as Atlas. Atlas may assist users with understanding ARLINOS, navigating functionality, product questions, onboarding, troubleshooting, and support guidance.
AI-generated information is provided as an assistance feature and should not be considered professional legal, financial, tax, medical, or other regulated professional advice.
13. Artificial intelligence
Certain ARLINOS functionality may use artificial intelligence and automated systems. Users acknowledge that AI systems are probabilistic and may occasionally generate incomplete, inaccurate, or unexpected outputs. ARLINOS may implement safeguards, monitoring, human escalation, usage limitations, and other controls designed to improve reliability and security.
Users must not intentionally use ARLINOS AI functionality to:
- Violate applicable law
- Mislead or impersonate individuals unlawfully
- Generate unlawful discriminatory decisions
- Infringe intellectual property rights
- Facilitate fraud
- Harass individuals
- Circumvent security controls
- Process information for prohibited purposes
Where applicable, ARLINOS will operate AI functionality in accordance with applicable European Union requirements for users in the EU.
14. Customer data
Businesses using ARLINOS may upload, create, process, or store information including customer information, appointment information, employee information, products, services, business records, communications, inventory information, transaction information, and other operational data.
As between ARLINOS and the customer, the customer retains its rights in its Customer Data. The customer grants ARLINOS the rights necessary to host, process, transmit, back up, and otherwise handle Customer Data solely as necessary to provide, secure, maintain, support, and improve the contracted services, subject to applicable law and contractual data-protection obligations. ARLINOS does not acquire ownership of Customer Data merely because it is stored on the Platform.
15. Data protection and GDPR
ARLINOS is designed to operate in accordance with applicable data protection laws, including, where applicable, the General Data Protection Regulation (EU) 2016/679 (“GDPR”) for customers and end users in the European Union.
Depending on the processing activity, ARLINOS and the business customer may have different legal roles. For personal data submitted by a business concerning its customers, employees, or other individuals, the business will generally act as the Data Controller, while ARLINOS may act as a Data Processor when processing that information on the business's instructions. ARLINOS may act as an independent controller for certain processing necessary to manage its own customer relationships, accounts, security, billing, legal obligations, and business operations.
Where required, processing performed on behalf of business customers will be governed by an appropriate Data Processing Agreement (“DPA”). Customers are responsible for ensuring they have an appropriate lawful basis for personal data they submit to ARLINOS.
16. End-customer privacy
Businesses using ARLINOS are responsible for informing their customers about how their personal data is collected and used. Businesses should maintain an appropriate privacy notice explaining, where applicable, what information is collected, why it is collected, the legal basis, who receives it, how long it is retained, applicable privacy rights, and how individuals may exercise those rights.
ARLINOS provides technology infrastructure but does not replace each business's independent data-protection obligations.
17. Data security
ARLINOS uses reasonable technical and organizational measures designed to protect information against unauthorized access, disclosure, alteration, loss, or destruction. However, no online service can guarantee absolute security.
Customers are responsible for maintaining appropriate security within their own organization, including secure passwords, appropriate access permissions, device security, employee access management, prompt removal of former employees, and protection of authentication credentials.
18. Data export and account termination
Where supported by the applicable plan and technically available, customers may export certain business data from ARLINOS. Following account termination or expiration, access to Customer Data may become limited or unavailable after an applicable retention period. Customers are responsible for exporting information they are legally required to retain before account deletion where export functionality is available.
ARLINOS may retain certain information where required for legal compliance, accounting, fraud prevention, security, dispute resolution, or enforcement of agreements. Any retained personal data remains subject to applicable data protection requirements.
19. Third-party services and integrations
ARLINOS may integrate with third-party platforms such as payment processors, email providers, messaging services, social networks, calendar services, cloud providers, accounting systems, advertising platforms, and other software providers. Third-party services may have their own terms, privacy policies, pricing, availability, and technical limitations.
ARLINOS is not responsible for failures caused solely by third-party services outside ARLINOS' reasonable control. ARLINOS may modify or discontinue an integration if the third-party provider changes or terminates the relevant service or API.
20. Acceptable use
You must not use ARLINOS to:
- Violate applicable law
- Commit fraud
- Send unlawful spam
- Upload malware
- Attempt unauthorized access
- Circumvent security systems
- Interfere with Platform operation
- Scrape the Platform without authorization
- Reverse engineer protected components except where applicable law expressly permits it
- Abuse APIs
- Misuse AI functionality
- Infringe intellectual property rights
- Process unlawfully obtained personal information
- Harass, threaten, or unlawfully discriminate against individuals
ARLINOS may investigate suspected misuse and take proportionate protective measures.
21. Intellectual property
ARLINOS and its licensors retain all rights, title, and interest in and to the Platform and its underlying technology, including, where applicable, software, source code, architecture, APIs, interfaces, designs, branding, logos, documentation, databases, AI systems, automation systems, and proprietary workflows.
These Terms grant customers a limited, non-exclusive, non-transferable right to use ARLINOS during the applicable subscription period according to their plan and these Terms. No ownership of ARLINOS technology is transferred to the customer.
22. Customer content
Customers retain ownership of content they lawfully upload or create through ARLINOS. Customers represent that they have the necessary rights and lawful basis to use and process such content, and must not upload content that unlawfully infringes third-party rights.
23. Platform availability
ARLINOS aims to provide reliable access to the Platform. However, uninterrupted or error-free availability cannot be guaranteed. Temporary interruptions may occur due to maintenance, security updates, infrastructure failures, third-party outages, internet failures, emergency maintenance, or events outside reasonable control. Where reasonably possible, ARLINOS will seek to minimize disruption. Specific uptime commitments, if any, may be governed by a separate Service Level Agreement.
24. Updates and changes to the Platform
ARLINOS is continuously developed. Features may be added, improved, modified, replaced, deprecated, or removed. ARLINOS will seek to avoid materially reducing core paid functionality during an active subscription without reasonable justification or notice where appropriate.
25. Suspension
ARLINOS may temporarily suspend access where reasonably necessary because of serious security risks, suspected fraud, illegal activity, material breach of these Terms, abuse of the Platform, non-payment, or threats to Platform infrastructure. Where reasonably possible and legally appropriate, ARLINOS will provide notice and an opportunity to resolve the issue.
26. Termination
ARLINOS may terminate an account for material breach of these Terms if the breach is not remedied within a reasonable period after notice, where remediation is possible. Immediate termination or suspension may occur where reasonably necessary for serious illegal activity, fraud, security threats, or deliberate abuse. Termination does not eliminate payment obligations that arose before termination.
27. Warranties
ARLINOS will provide the Platform with reasonable professional care. Except for warranties that cannot legally be excluded, the Platform is provided on an “as available” basis. ARLINOS does not guarantee continuous availability, that every feature will be error-free, specific commercial results, specific increases in revenue, specific numbers of bookings, specific marketing outcomes, or that AI outputs will always be accurate.
Nothing in these Terms excludes mandatory statutory warranties or rights that cannot legally be waived.
28. Limitation of liability
To the maximum extent permitted by applicable law, ARLINOS will not be liable for indirect or consequential losses such as loss of anticipated profits, business opportunities, or goodwill arising from use of the Platform, except where such liability cannot legally be excluded.
For paid business services, ARLINOS' aggregate contractual liability arising from the Platform may be limited to the fees paid by the affected customer to ARLINOS during the twelve (12) months preceding the event giving rise to the claim.
This limitation does not apply where liability cannot legally be limited, including where applicable in cases involving fraud, intentional misconduct, death or personal injury caused by negligence, or other mandatory statutory liability.
29. Force majeure
Neither party will be responsible for delays or failures caused by circumstances reasonably beyond its control, including major internet failures, natural disasters, war, governmental actions, widespread infrastructure failures, or major third-party service disruptions. This provision does not excuse payment obligations already due.
30. Changes to these Terms
ARLINOS may update these Terms to reflect new functionality, changes in law, security requirements, operational changes, new services, or regulatory requirements. Material changes will be communicated through appropriate means where required. The effective date is displayed at the top of this page.
31. Governing law and jurisdiction
Unless mandatory law requires otherwise, these Terms are governed by the laws of Costa Rica. Any dispute arising from these Terms will be subject to the competent courts of San José, Costa Rica, unless another jurisdiction is required by mandatory applicable law where you reside.
32. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will, where legally possible, be interpreted or replaced in a manner that most closely reflects its intended purpose.
33. Entire agreement
These Terms, together with any applicable subscription agreement, order form, Privacy Policy, Data Processing Agreement, Service Level Agreement, and additional product-specific terms, constitute the agreement governing use of ARLINOS. Where a separately executed agreement expressly conflicts with these Terms, the separately executed agreement will prevail to the extent of the conflict.

35. Acceptance
By creating an ARLINOS account, purchasing a subscription, or continuing to use the Platform after being presented with these Terms, you acknowledge that you have read and agree to these Terms and Conditions of Use.
